TEMPORARY ACCESS EASEMENT <br /> This Temporary Access Easement is made this day of , 2021,by LVP, <br /> LLC, a Minnesota limited liability company, Grantor, in favor of the City of New Brighton, <br /> Minnesota, a municipal corporation under the laws of the State of Minnesota, Grantee (the "City") <br /> and the Metropolitan Council, a public corporation and political subdivision of the State of <br /> Minnesota("MCES"). <br /> Recitals <br /> A. Grantor is the fee owner of the property located in Ramsey County, Minnesota (the <br /> "Property") and legally described on Exhibit A attached hereto. <br /> B. The City and MCES are rehabilitating the Long Lake interceptor and are in need of a <br /> temporary access easement over the Property to provide the City and MCES with a route from 10t1i <br /> Street NW to the interceptor construction area. <br /> C. Grantor desires to grant to the City and MCES a temporary access easement (the <br /> "Easement")according to the terms and conditions contained herein. <br /> Terms of Temporary Access Easement <br /> 1. Grant of Temporary Easement. For good and valuable consideration, receipt and <br /> sufficiency of which are acknowledged by Grantor, Grantor grants to the City and MCES a non- <br /> exclusive, temporary access easement over and across the Property for the purpose of accessing the <br /> interceptor construction site from 10t1i Street NW. The Easement Area is legally described on <br /> Exhibit B (the"Easement Area") and depicted on Exhibit C attached hereto. <br /> 2. Scope of Easement. The above-described easement permits the City and MCES and their <br /> contractors, agents, and employees to enter upon the Easement Area, with construction vehicles <br /> and equipment, in order to access the interceptor construction site. <br /> NE136-24-727068.v1 <br />
