Agenda Section: Consent <br /> NEW Report Date: 7/21/2021 <br /> Council Meeting Date: 7/27/2021 <br /> 414 <br /> BRIGHTON <br /> building tomorrow today <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Consider Approval of Updated MN Government Data Practices Policies: a <br /> Policy for Members of the Public, a Policy for Data Subjects and an Internal Data Policy <br /> DEPARTMENT HEAD'S APPROVAL: <br /> CITY MANAGER'S APPROVAL: <br /> No comments to supplement this report Comments attached <br /> Recommendation: <br /> Approve the following updated MN Government Data Practice (MNGDP)Policies: <br /> • Data Policy for Members of the Public <br /> • Data Policy for Data Subjects <br /> • Internal Data Policy for Staff Members and Officials, including a Data Inventory <br /> Legislative History: <br /> Minnesota State Statutes, Chapter 13, also known as the MN Government Data Practices Act <br /> (MGDPA), requires that prior to August 1st of each year, every government entity annually <br /> update and approve their MGDPA policies regarding public access to data,the rights of <br /> subjects of data,and internal treatment and protection of government data.These policies <br /> were not updated during the pandemic as there were no legislative changes that affected <br /> the City's data policies. <br /> • MN Government Data Practices Policy for Members of the Public <br /> This policy explains the rights of the public in accessing data maintained by the City. It <br /> is to be made available to the public by providing free copies on request, by posting it <br /> at City Hall or by posting it on the City website.This policy must also be updated <br /> annually to reflect any changes in personnel, procedures or other circumstances that <br /> affect the public's ability to access data. (Minnesota Statutes section 13.025, <br /> subdivisions 2 and 4.) <br /> Changes made to this policy include: Staff contact updates and clarification of technical <br /> terms.There were no legislative changes in 2020 or 2021 that affected this policy. <br /> • MN Government Data Practices Policy for Data Subjects <br /> This policy explains the rights of data subjects and explains the specific procedures an <br /> individual should use to access public or private data the City has created, has received, <br /> uses or maintains.This policy must also be made available to the public by providing free <br /> copies of the policy on request, by posting it at City Hall or by posting it on the City <br /> website. It must also be updated annually as necessary to reflect changes in personnel, <br />
