<br />~I <br /> <br />RESOLUTION NO. 94-85 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON <br />(GENERALLY, 12TH AVENUE NW AT HANSEN PARK). <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property <br />in the City of New Brighton described as follows: <br /> <br />Moylan Existing Legal Description <br /> <br />That part of Lot 5, Block 4, Mork-Campion Terrace, described as follows: <br />Beginning at the southwest corner of said Lot 5; thence north 0 degrees 22 <br />minutes 30 seconds west (assumed bearing) along the west line of said Lot 5 a <br />distance of 100.00 feet to the northwesterly corner of said lot 5; thence north <br />54 degrees 11 minutes 46 second east along the northerly line of said Lot 5 a <br />distance of 82.88 feet; thence south 55 degrees 22 minutes 30 seconds east a <br />distance of 92.07 feet to the southeasterly lot line of said Lot 5; thence south <br />40 degrees 54 minutes 27 seconds west along said southeasterly lot line a <br />distance of 127.25 feet to the southeasterly corner thereof; thence on a bearing <br />of west a distance of 59.00 feet to the point of beginning. <br /> <br />Barrett Existing Legal Description <br /> <br />Lot 6, Block 4, Mark-Campion Terrace <br /> <br />WHEREAS, the State Statutes require that if such property is located in municipalities <br />that have adopted a platting ordinance, approval of the municipality must be obtained <br />before such subdivision can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of <br />property without platting if certain criteria can be met; and <br /> <br />WHEREAS, the City Council has determined that such criteria has been met. <br /> <br />Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON approves <br />subdivision of the above described property into parcels described as follows: <br /> <br />Proposed New Legal Description for Moylan Property <br /> <br />That part of Lots 5 & 6, Block 4, Mark-Campion Terrace, described as follows: <br />Commencing at the most southeasterly corner of Lot 6, Block 4, Mork-Campion <br />Terrace; thence S 89045'22" W a distance of 130.00 feet along the southerly line of <br />said Lot 6, to the southwesterly corner of said Lot 6; thence S 89045'22" W a <br />distance of 59.00 feet along the southerly line of said Lot 5 to the southwesterly <br />corner of said Lot 5; thence N 00021 '31" E a distance of 100.83 feet (recorded as <br />100.00 feet) along the easterly line of 12th Avenue N.W. and along the westerly line <br /> <br />Page 1 of 2 <br />
