<br />1.. <br /> <br />,. <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 94-073 <br /> <br />A RESOLUTION AUTHORIZING EXECUTION AND DELIVERY OF A SECOND <br />AMENDMENT TO THE CONTRACT FOR PRIVATE REDEVELOPMENT BY AND <br />BETWEEN THE CITY OF NEW BRIGHTON AND CHARLES E. STARK. <br /> <br />BE IT RESOLVED by the City Council (the "Council") of the <br />City of New Brighton (the "City") as follows: <br /> <br />Section 1. Recitals. <br /> <br />1.01 It has been proposed that the City enter into a <br />Second Amendment to the Contract for Private Redevelopment (the <br />II Second Amendment") with Charles E. Stark (the "Redeveloper"). <br /> <br />Section 2. Findinqs. <br /> <br />2.01 The Council hereby finds that the Second Amendment <br />promotes the objectives as outlined in its Modified Development <br />program established pursuant to Minnesota Statutes, Sections <br />469.001 et seq. <br /> <br />2.02 The Council hereby finds that it has approved and <br />executed a Contract for Private Redevelopment between the City <br />and the Redeveloper dated as of December 1, 1992 <br /> <br />2.03 The Council hereby finds that it has approved and <br />executed a First Amendment to the Contract for Private <br />Redevelopment between the City and the Redeveloper dated as of <br />October 15, 1993. <br /> <br />Section 3. Authorizations. <br /> <br />3.01 The Mayor and the City Manager (the "Officers") <br />are hereby authorized to execute and deliver the Second Amendment <br />when the following condition is met: <br /> <br />Substantial conformance ofa Second Amendment to the <br />Second Amendment presented to the City as of this date <br />with such additions and modifications as the Officers <br />
