Public Hearing <br />(A) Special Use Permit: Request from Richard Brickner to authorize replacement of an existing <br />detached garage with new detached garage exceeding 624 square feet on the property at <br />1233 12th Avenue NW – PID 20-30-23-31-0011 <br />Assistant Director of Community Assets and Development Gozola reported Richard Brickner, <br />owner of the home at 1233 12th Avenue NW, is seeking approval to tear down an existing legal <br />nonconforming detached garage in order to construct a new, larger, detached garage <br />conforming to setbacks. The new garage would be just over 1000 square feet in size, and will <br />include an unfinished upper level currently intended for storage. Staff provided further <br />comment on the request and recommended approval of the Special Use Permit, based on the <br />findings of fact and subject to the following conditions: <br />1. The Special Use Permit shall authorize the location and size of garage as shown on the <br />Certificate of Survey for 1233 12th Ave NW dated March 9, 2022; any changes to the <br />location or size of the garage addition shall require an amendment to this permit. <br />2. Roof and exterior color and material(s) must be consistent and complimentary with the <br />principal structure. <br />3. No commercial or home occupation activity shall be conducted within the detached <br />garage. <br />4. Unless allowed by zoning, no portion of the detached garage shall be maintained as an <br />accessory dwelling unit. <br />5. Final building plans must show the resulting drainage patterns around the structures will <br />not adversely impact neighboring properties. <br />6. The applicant is strongly advised (but not required) to televise the home’s existing <br />sanitary sewer service line prior to construction of the new garage, and make any <br />necessary repairs at this time. <br />7. Failure to adhere to conditions of approval shall be grounds for revocation of the special <br />use permit by the City Council. <br />Commissioner Frischman asked if the resident would be building this garage himself. Assistant <br />Director of Community Assets and Development Gozola stated staff does not have this <br />information. He indicated the City was more concerned with the placement and size of the <br />garage.
