<br /> <br />5 <br /> <br />Motion by Commissioner Biedenfeld, seconded by Commissioner McQuillan to close the <br />Public Hearing. <br />Approved 7-0. <br />The public hearing was closed at 7:21 p.m. <br />Commissioner Biedenfeld thanked staff for the detailed list of conditions for this request. <br />Commissioner McQuillan thanked Donatelle’s for facilitating discussions between these two <br />users. <br />Commissioner Frischman discussed the easement that was in place for the nine parking spaces. <br />She recommended signage be required for these nine spaces. <br />Commissioner McQuillan supported this recommendation and suggested Condition 1C be <br />amended to include this language. <br />Commissioner Frischman indicated a shared parking agreement would be in place for this <br />property, along with a land maintenance and stormwater management agreements. Assistant <br />Director of Community Assets and Development Gozola reported this was the case. <br />Motion by Commissioner McQuillan, seconded by Commissioner Allen to recommend the City <br />Council approve the proposed Preliminary Plat, Final Plat, SUP and Variance Request based <br />on the findings of fact and conditions listed within the staff report as amended. <br />Approved 5-0. <br />VII. Business Items <br />(A) Site Plan Review: Sunny Square Park Improvements. <br />Assistant Director of Community Assets and Development Gozola reported the City of New <br />Brighton is seeking authorization to rehabilitate facilities at Sunny Square Park in accordance <br />with the recently approved 2040 Park & Trail System Master Plan. Staff provided further <br />comment on the proposed park improvements and recommended approval of the Site Plan <br />based on the findings of fact with the following conditions: <br />1. Parks Department staff shall continue to review any updates as they occur. Major changes <br />(i.e. significant changes to design, setback impacts, etc.) will be brought back through the <br />process while minor changes will be reviewed and approved administratively. <br />2. Public safety shall continue to review updates as they occur, and may direct plan updates <br />to deal with safety concerns as plans are finalized. <br />3. Building materials shall be in line with those anticipated and required by code.
