<br />!. <br /> <br />,. <br /> <br />RESOLUTION NO.94-068 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PL-211 AND PRO-58. <br /> <br />WHEREAS, an application for PL-211 and PRO-58 has been made by Rottlund Company; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for PL-211 and PRO-58 was filed with the City of New Brighton on <br />April 1, 1994. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on April 19, 1994, and May 17, 1994. and all persons present at the <br />hearing were given an opportunity to be heard. <br />3. The City Council considered PL-211 and PRO-58 on May 24, 1994. <br /> <br />Now, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to PL-211 and PRO-58: <br /> <br />1. The subject site is zoned B-4, Downtown Business. <br />2. The B-4 district recognizes the unique character and circumstances of the <br />downtown area and in order to create a harmonious and attractive development <br />pattern allows for flexibility in the application of the Zoning Ordinance standards <br />and requirements. <br />3. The proposed 74 unit townhouse development is being processed as a Planned <br />Residential Development (PRO). <br />4. The PRO Ordinance encourages flexibility in the enforcement of the Zoning <br />Ordinance density and setback requirements if it can be shown by the applicant the <br />development would encourage social interchange, life-cycle environment, and <br />efficiency in the use of land without creating a detriment to public health, safety, <br />morals, or general welfare. <br />5. The proposed 74 unit townhouse development would be harmonious with existing <br />and developing land uses in the downtown area and would improve the aesthetics <br />of the downtown area through new residential structures and landscaping that <br />would compliment the proposed 5th Avenue NW streetscape and landscaping plan. <br />6. The proposed preliminary PRO and Preliminary Plat would comply with the B-4 <br />district/PRO standards and with the Chapter 26 Subdivision standards. <br /> <br />BE IT FURTHER RESOLVED, the application for PL-211 and PRO-58 is hereby approved subject <br />to the following condition: <br /> <br />1.
