<br />AGREEMENT FOR PROSECUTION SERVICES <br />BETWEEN <br />CITY OF NEW BRIGHTON <br />AND <br />GDO LAW <br /> <br />This agreement is by and between the City of New Brighton, hereinafter called “City” and <br />GDO Law, hereinafter called “Prosecutor”. <br /> <br />WHEREAS, City has need of the services of an attorney at law licensed to practice law in <br />the State of Minnesota to advise and represent City in municipal prosecutions, and <br /> <br />WHEREAS, Prosecutor is licensed to practice law in the State of Minnesota and is <br />experienced in and familiar with all phases of municipal prosecution and is desirous of providing <br />the prosecution services required by City, and <br /> <br />WHEREAS, the parties hereto desire to enter into a written agreement to set forth the <br />terms, conditions, compensation, duties, responsibilities and other matters relating to Prosecutor <br />providing prosecution services to City. <br /> <br />NOW, THEREFORE, it is agreed by and between City and Prosecutor that City does <br />hereby retain and designate Prosecutor as the New Brighton City Prosecutor, effective January 1, <br />2023 for a three-year contract term ending on December 31, 2025. Prosecutor does hereby accept <br />the position of New Brighton City Prosecutor and agrees to perform the requirements of that <br />position, all on the terms and conditions hereinafter set forth. <br /> <br />1. Designated Attorney. Heather Monnens is hereby designated as Chief City <br />Prosecutor, with Robb Olson and Matt Moertel of GDO Law designated as <br />Assistant City Prosecutors, who shall conduct all prosecutions for City. <br /> <br />2. Term of Contract – Contract Amount. The contract term is for three years. For <br />all prosecution services, City shall pay Prosecutor a monthly retainer in the sum <br />of $7,085 per month or $85,020 annually for 2023; $7,297 per month or $87,564 <br />annually for 2024; and 7,515 per month or $90,180 for 2025. There will be no <br />extra fee for copying costs, postage, or travel time and/or mileage. Prosecutor <br />will be reimbursed for any out-of-pocket costs such as witness fees, service of <br />process fees, couriers, and costs relating to any appeals. <br /> <br />3. Responsibilities of Prosecutor. Prosecutor hereby agrees to perform and <br />furnish the following legal services: <br />i. Advise and train all law enforcement personnel with regard to laws <br />relevant to their department and the prosecution of criminal cases as <br />requested. <br />ii. Consult with citizens on complaints of ordinance and statute violations. <br />iii. Preparation of criminal complaints.
