Planning Report <br />Planned Residential Development Amendment <br /> <br /> <br />To: Planning Commission <br />From: Ben Gozola, Assistant Director DCAD <br />Meeting Date: 3-21-23 <br />Applicants: Margaret & James Glodek and the Silver Oak Estates No. 2 Home Owners <br />Association <br />Main Contact: Kayla Campobasso, HOA Representative <br />Location: 3024-3054 18th Street NW <br />Zoning: R-1 <br /> <br />Introductory Information <br />Project: The Glodek family and the Silver Oak Estates No. 2 home owners association are jointly <br />seeking authorization to amend the Silver Oak Estates No. 2 Planned Residential <br />Development (PRD) to add a lot line to the plat which would place the existing home <br />at 3024 18th Street NW on its own independent lot. <br /> <br />History:  The Silver Oak Estates Planned Residential Development is approved in 1973. The <br />plat allows for the construction of up to nine (9) housing units in specific locations. <br /> Buildout of the development over the years resulted in the eight (8) units currently <br />present on the site (3024, 3028, 3032, 3036, 3040, 3044, 3048, and 3050). The ninth <br />unit at 3054 was never constructed, but it could still be built if the association <br />acquired a building permit and could overcome the development issues (relocation <br />of underground utilities in the area have made construction uneconomical). <br /> In approximately 2012, the Glodek family (owners of 3024 18th St. NW) and the <br />Home Owners Association (HOA) jointly agreed to sever that unit from the HOA. <br />The Glodek’s wished to have their home on a separate lot and to stop paying HOA <br />dues, and the HOA sought to eliminate their duty to maintain the home/structure at <br />3024. Both sides viewed the mutual divorce as a win-win. <br /> In 2022, the Glodek family sought a building permit from the City to place an <br />addition onto their home, and the permit request was denied. As a result of the <br />changes implemented by the Glodek’s and the HOA in 2012, the Glodek’s no longer <br />had any legal right to the land surrounding their home. Not only could the City not <br />issue a building permit authorizing construction on a neighbor’s land, but we <br />pointed out that technically the Glodek’s were probably trespassing through HOA <br />property to enter and exit the home given the current framework. The City advised <br />them to seek legal counsel to identify a solution with the HOA.
