The use of the building and site will not disturb or endanger the <br />public. Operations will be handled safely inside the building. Outside auto and truck vehicle <br />parking and loading are ordinary uses. A new above-grad 6,000 gallon diesel fuel tank (AST) is <br />regulated by the MPCA, and will also require a City Permit. It may also require approval by Rice <br />Creek Watershed District, which we will inquire about. It will be UL142 listed. It will not emit <br />odors to surrounding properties. A formal Spill Response Plan and Spill Kits will be in place in <br />case of emergency. <br />STAFF COMMENTS: Staff finds this criterion to be met. The property has been <br />home to a warehousing/sorting/distribution use for over two decades, and the <br />proposed use will largely mimic what’s always been there (albeit centered around a <br />different commodity). As the former use worked fine on the property, we anticipate <br />the same will hold true with the proposed use. <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />Applicant Comments: Correct. The neighborhood will not be negatively impacted by the proposed <br />operation; nor should it negatively impact surrounding property values. <br />STAFF COMMENTS: Staff finds this criterion to be met with conditions. As noted <br />in the applicant’s response to criteria #1, “operations will be handled safely within <br />the building.” Staff agrees that statement will be a critical to ensuring this use will <br />not be injurious to surrounding uses. As shown in this aerial below on the current <br />site in Minneapolis, operations on the exterior of the business will result in an <br />unsightly mess that undoubtably impacts surrounding lands as papers get carried by <br />the wind.
