<br />NE136-14-858573.v1 <br />Mayor Kari Niedfeldt-Thomas’s Minnesota Statutes Section 13D.021 Statement and <br />Determination Regarding Conducting Meetings by Telephone or Other Electronic Means <br /> <br />As the Mayor of the City of New Brighton, Minnesota, I find as follows: <br /> <br />a. In October 2021, I determined that it was appropriate to allow remote public meetings in <br />the City under Minnesota Statutes Section 13D.021 because holding meetings in-person <br />was not prudent or practical, and it was not feasible to have the entire City Council, City <br />staff, and the public at the City’s regular meeting location due to the ongoing state and <br />local emergency declarations related to the ongoing COVID-19 pandemic; <br /> <br />b. To return to in-person meetings, the Mayor must make a new determination that meetings <br />will no longer be conducted under Minnesota Statutes Section 13D.021; <br /> <br />c. Pursuant to the Centers for Disease Control and Prevention, many people in the United <br />States now have some protection, or immunity against COVID-19 due to vaccination, <br />previous infection, or both. This immunity, combined with the availability of tests and <br />treatments, has greatly reduced the risk of severe illness, hospitalization, and death from <br />COVID-19 for many people; <br /> <br />d. According to the CDC web site, in Ramsey County, Minnesota, the COVID -19 <br />community level is low; <br /> <br />e. Because the COVID-19 community level is low and because many people now have <br />protection or immunity against COVID-19 due to vaccination, previous infection or both, <br />it is no longer necessary to conduct City meetings pursuant to Minnesota Statutes Section <br />13D.021; and <br /> <br />f. The City may continue to allow members of the public and members of the City Council, <br />and all of its boards, committees, subcommittees, and commissions, to participle remotely <br />during in-person public meetings as permitted by law (Minnesota Statutes Section 13D.02 <br />(meetings conducted by interactive technology)). <br /> <br />Based on the above findings, I determine as follows: <br /> <br />1. My Statement and Determination Regarding Conducting Meetings by Telephone or <br />Other Electronic Means is hereby rescinded as of April 1, 2023. <br /> <br />2. As of April 1, 2023, all meetings of the City Council and its boards, committees, <br />subcommittees, and commissions shall be conducted in-person, allowing for remote <br />participation as permitted by law, including under Minnesota Statutes Section 13D.02. <br /> <br /> <br />Dated this ____ day of ________, 2023. _____________________________ <br /> Kari Niedfeldt-Thomas <br /> Mayor, City of New Brighton
