Agenda Section: VI (consent)
Item: 8
Report Date: 8/16/23
Meeting Date: 8/22/23
REQUEST FOR COUNCIL CONSIDERATION – EXECUTIVE SUMMARY
ITEM DESCRIPTION: Consider a New Resolution Setting a Public Hearing on a Street
Vacation
DEPARTMENT HEAD’S APPROVAL: _________ CITY MANAGER’S APPROVAL: __________

Action Requested: ☐ Public Hearing ☒ Motion ☐ Discussion ☐ Informational
Form of Action: ☒ Resolution ☐ Ordinance ☐ Contract/Agrmnt ☐ N/A ☐ Other
Votes Needed: ☒ Majority (3 votes) ☐ Super Majority (4 votes) ☐ Unanimous ☐ N/A

Summary Statement: In July while reviewing the SUP application from Appletree
Dental at 2201 26th Avenue NW, the City identified a number of
old and unused ROW segments which should be turned back to
private property owners in the area. Council directed staff to
begin the vacation process, and a resolution setting a public
hearing for August 22nd was approved. Unfortunately, as of
8/16/23, the title company working with our surveyor is still
completing the work that will allow the surveyor to prepare the
necessary legal exhibits. In light of this delay which is out of our
hands, staff has prepared a new resolution setting the vacation
public hearing for 9/26/23.
Recommendation(s): Approve the resolution to set a public hearing to vacate unused
areas of right-of-way
Applicable Deadlines: None
Legislative History: City Council reviewed the Appletree Dental SUP application on
June 27th, 2023, and directed staff to initiate this right-of-way
vacation process on behalf of the neighborhood.
