Staff will be bringing a full ordinance to the City Council in <br />early January and is looking for guidance on policy direction from <br />the City Council. <br />Recommendation(s): Clarify intent / goals of updating the licensing regulations. <br /> Determine if a cap of 6 stand-alone tobacco shop licenses is <br />acceptable. <br /> Provide direction regarding whether the number of stand-alone <br />tobacco shop licenses should be reduced over time. <br /> Provide direction regarding whether a 1,000-foot restriction <br />around youth-oriented facilities is acceptable. <br /> Determine if businesses with stand-alone tobacco shop licenses <br />should be required to open within a certain amount of time after <br />obtaining their license. <br /> Consider any potential equity impacts of new regulations. <br />Applicable Deadlines: Staff plans to bring a complete ordinance to the City Council at <br />their January 9, 2024 meeting but needs direction tonight in <br />order to continue work and next steps. <br />Legislative History: January 10, 2023 - Staff informed Council of a high number of <br />tobacco shop license applicants compared to surrounding <br />communities. Council supported a licensing moratorium to <br />evaluate potential changes. <br /> January 24, 2023 – City Council approved a one-year moratorium <br />on new Tobacco shop licenses.
