<br />~ <br /> <br />RESOLUTION NO. 94-039 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-297. <br /> <br />WHEREAS, an application for a variance has been made by National Handicap Housing <br />Institute, Inc.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on February 28, <br />1994. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on March 15, 1994, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered all information on VN-297 on March 22, 1994. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-297: <br /> <br />1. The subject property is zoned R-3A, Multiple Family Residential. <br />2. The subject property would be developed as a Planned Residential Development, <br />which requires a 25 foot setback for buildings and parking from the perimeter of the <br />site. <br />3. The proposed housing facility would be setback 10 feet from the west property line <br />and the off-street parking area would be setback 17 feet from the Thorndale Avenue <br />NW right-of-way. <br />4. The applicant has made adjustments to the development site plan to locate the <br />building and parking as far from the residences to the east as possible. <br />5. The narrowness of the site and the need to provide parking in front of the proposed <br />building to accommodate the mobility impaired residents has prevented the applicant <br />from meeting the 25 foot PRO perimeter setback requirement. <br />6. The proposed variance would not have a negative impact on surrounding land uses or <br />alter the character of the area. <br />7. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship pertaining to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-297 is hereby approved, subject to the <br />following condition: <br /> <br />1.
