'7 <br /> <br />''! <br /> <br />RESOLUTION NO. 94 -0 15 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-296. <br /> <br />WHEREAS, an application for a variance has been made by Northco; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on <br />December 2, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on December 21, 1993, and January 18, 1994, and all persons present at <br />the hearing were given an opportunity to be heard. <br />3. The City Council considered VN-296 at its January 25, 1994, meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-296: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />2. The required frontyard setback for off-street parking in an 1-2 district is 40 feet. <br />3. The requested 25 foot setback variance would allow a portion of the proposed <br />off-street parking area to be located 15 feet from the 2nd Street NW right-of-way. <br />4. The odd configuration of the subject lot caused by the cul-de-sac bulb <br />right-of-way, combined with the narrowness of the lot, create a unique <br />circumstance, which places design constraints on the subject lot. <br />5. The proposed landscape plan would provide for plantings and a berm that would <br />serve to screen the off-street parking area from 2nd Street NW and soften the <br />impact of the reduced setback area. <br />6. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship. <br /> <br />BE IT FURTHER RESOLVED, the application VN-296 is hereby approved subject to the <br />following conditions: <br /> <br />1.
