<br />1. <br /> <br />RESOLUTION NO.94-011 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-295. <br /> <br />WHEREAS, an application for a variance has been made by Industrial Equities, Inc.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on December 3, <br />1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on December 21, 1993, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered VN-295 on January 11, 1994. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the Planning Commission makes the following Findings <br />of Fact in respect to VN-295: <br /> <br />1. The subject property is zoned 1-1, Light Industrial. <br />2. The required street sideyard setback in an 1-1 district is 40 feet or 20 feet by <br />permission of the City Council. <br />3. The City Council reduced the street sideyard setback to 20 feet for the subject site <br />on September 28, 1993, when LP-282 was approved. <br />4. The applicant is requesting a 5 foot street sideyard setback variance to construct a <br />proposed off-street parking Jot 15 feet from the Lakeview Point street right-of-way. <br />5. The 150 foot setback from Jones Lake reduced the amount of buildable area in the <br />Lakeview Business Campus plat and reduced the width of the subject lot. <br />6. To comply with the requirements of the American Disabilities Act (ADA), a 10 foot <br />strip of sidewalk and green area is designated in front of the proposed building. This <br />strip forced the off-street parking area 5 feet closer to the Lakeview Point right-of- <br />way. <br />7. Lakeview Point is a cul-de-sac and not a through street serving the subject site and <br />the U.S. West site to the north. <br />8. The proposed variance would not have a negative impact on surrounding land uses or <br />alter the character of the area. <br />9. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship pertaining to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-295 is hereby approved. <br /> <br />Adopted this 11th day of January, 1994. <br /> <br /> <br />~~aYo< <br />1'11#(f~/ ,8 (Jeki- <br /> <br />Manhew S.
