<br />RESOLUTION NO. 93-129 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A SPECIAL USE <br />PERMIT SP-18l. <br /> <br />WHEREAS, an application for SP-18l has been made by John Ordway to allow a commercial <br />development in a B-4 district; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1 . An application for a special use permit was filed with the City of New Brighton on <br />October 2, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on October 19 , 1993, and all persons present at the hearing were given an opportunity <br />to be heard. <br />3. The City Council considered SP-181 on October 26, 1993. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to SP-l 81 : <br />1. The subject site is zoned B-4, Downtown Business. <br />2. The construction of commercial buildings in a B-4 district requires a Special Use Permit. <br />3. The applicant is proposing to construct 6 individual buildings on the subject site for office, <br />business service, and retail purposes. <br />4. The proposed development would establish reduced front yard setbacks for the proposed <br />buildings and parking lots along 5th Avenue NW and 10th Street NW. <br />5. The B-4 district allows for flexibility in design and setbacks for structures due to the <br />unique character and circumstances of the downtown area, to maintain a harmonious <br />pattern of development in downtown New Brighton, and because the strict enforcement <br />of certain existing Zoning Code requirements would inhibit new development or <br />redevelopment in the downtown area. <br />6. The proposed development would be in keeping with the overall development plan for <br />downtown New Brighton. <br />7. The establishment, maintenance or operations of the special use will not be detrimental to <br />or endanger the public health, safety, morals, comfort of general welfare. <br />8. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />9. The establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />10. Adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />11.
