<br />.:! <br /> <br />'- <br /> <br />RESOLUTION NO. 93.120 <br />CITY OF NEW BRIGHTON <br /> <br />'" <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A <br />SPECIAL USE PERMIT SP-180 <br /> <br />WHEREAS, an application for a special use permit has been made by Innsbruck <br />Health Care Center to allow for the construction of an addition onto an existing nursing <br />home. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1 . An application for a special use permit, SP-180 was filed with the City of <br />New Brighton on September 3, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on September 21, 1993, and all persons present at the <br />hearing were given an opportunity to be heard. <br />3. The City Council considered SP-180 on September 28, 1993; <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings <br />of Fact in respect to SP-180: <br /> <br />1 . The subject site is zoned R-3B, Multiple Family Residential. <br />2. A nursing home is a special use in the R-3B District. <br />3. Innsbruck Health Care Center is an existing nursing home proposing to <br />construct a 7,280 sq. ft. addition <br />4. Any expansion or enlargement of an existing special use requires the <br />issuance of a special use permit. <br />5. The proposed expansion would not increase the number of residents at the <br />nursing home but would only serve to reduce the number of beds per <br />resident room from 3 or 4 beds to 1 or 2 beds. <br />6. The proposed expansion would also include the construction of a 66 stall <br />lighted parking lot behind the existing facility which would eliminate the <br />need for on street parking, increase the level of site security, and reduce <br />the impact on surrounding land uses. <br />7. The establishment, maintenance or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, or comfort of <br />the general public. <br />8. The special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />9. The establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses <br />permitted in the district. <br />10. Adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />11. The special use shall in all other respects, conform to the applicable <br />regulations of the district in which it is located. <br />
