<br />RESOLUTION NO. 93-119 <br /> <br />ST ATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF VN~294 <br /> <br />WHEREAS, an application for a variance has been made by Gregory Ulrich; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for variance was filed with the City of New Brighton on September <br />3, 1993. <br />2. The PlalUling Commission, pursuant to published and mailed notices, held a public <br />hearing on September 21, 1993, and all persons present at the hearing were given <br />an opportunity to be heard. <br />3. The City Council considered VN-294 on September 28, 1993. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-294: <br /> <br />1. The property is zoned R-l, Single Family Residential. <br />2. The required front yard setback in the R-l district is 30 feet. <br />3. The applicant is requesting a 12 foot front yard setback variance to construct a <br />garage addition 18 feet from the north front yard property line, which borders the <br />Valley View Lane right of way. <br />4. The subject lot has a steep slope in the backyard making it difficult and impractical <br />to place the proposed garage addition on the subject lot and still comply with the <br />required sideyard setbacks. <br />5. The proposed garage addition would not have a negative impact on surrounding <br />properties and would be in keeping with the character and aesthetics of the <br />neighborhood. <br />6. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship pertaining to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-294 is hereby approved. <br /> <br />Adopted this 28th day of September, 1993 <br /> <br />.".'- <br /> <br /> <br />-~A TTEST .>--' <br />:"- ..-~ <br /> <br />M3Ig~ Citr Clerk <br /> <br />(SEAL) <br />
