<br />~ <br /> <br />~ <br /> <br />RESOLUTION NO. 93-094 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A <br />UTILITY EASEMENT (generally located within the property known as Innsbruck Park Estates III <br />Addition) . <br /> <br />WHEREAS, the procedural history of the petition is as follows: <br /> <br />1. That Harstad Company, property owner, petitioned the vacation of the subject utility <br />easement on July 2, 1993; <br />2. That the City Council, pursuant to published and mailed notices held a public hearing <br />on July 27, 1993, all persons present at the hearing were given an opportunity to be <br />heard; <br />3. That the written comments and analysis of City Staff were considered. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council ofthe City of New <br />Brighton makes the following Findings of Fact in respect to the proposed vacation: <br /> <br />1. That the subject utility easement is located on property owned by Harstad Company; <br />2. That the existing sanitary sewer pipe will be rerouted on site; <br />3. That the development of the property will be impeded by this easement if not vacated; <br />4. That the subject utility easement would serve no public purpose after the sanitary <br />sewer pipe is rerouted. <br /> <br />BE IT FURTHER RESOLVED that the Council hereby vacates the utility easement <br />described below: <br /> <br />The South 115 feet of the 40 foot drainage easement as created and dedicated on the <br />easterly 40 feet of the Park as platted in INNS BRUCK PARK ESTATES, Ramsey <br />County, Minnesota. <br /> <br />Adopted this 27th day of July, 1993. <br /> <br />~ <br /> <br />ATTEST: <br /> <br /> <br />."-- <br />- - <br /> <br />-" ~~ <br /> <br />MaFgaret- Egan, <br />Finance Director/City Clerk <br /> <br />(SEAL) <br />
