<br />'!I, <br /> <br />RESOLUTION NO. <br />06-027 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br /> <br />ON MAKING FINDINGS OF FACT AND APPROVAL OF SITE PLAN (LP05-13), PRELIMINARY PLAT <br />), AND PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD05-02) FOR A PORTION OF THE <br />ST QUADRANT. <br /> <br />WHERE ,an application has been made by David Bernard Builders and Developers (the "Applicant") to <br />be con i ered for a site plan review, preliminary plat, and planned unit development. <br /> <br />WHERE ,the procedural history of the application is as follows: <br /> <br />1. application for a site plan review, preliminary plat, planned unit development with the City of <br />ew Brighton on December 29,2005. <br /> <br />2. he City of New Brighton has determined that a re.zoning of the project area from Mixed-Use <br />MX) to Multiple-Family Residential (R3A) is also needed in conjunction with the planned unit <br />evelopment. <br /> <br />3. ublic hearing notices for a site plan review, preliminary plat, planned unit development and re- <br />oning were published in the New Brighton Bulletin on January 4, 2006. <br /> <br />4. ublic hearing notification was distributed to all property owners within 600 feet of the subject <br />site. <br /> <br />5. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />January 17,2006 and voted to continue the public hearing until January 31,2006. <br /> <br />6. On January 31, 2006, the Planning Commission continued the public hearing and considered the <br />Applicant's plans and recommended preliminary review approval of the land use applications <br />subject to conditions. <br /> <br /> <br />AS, the City Council makes the following Findings of Fact in respect to Site Plan (LP05-13), <br />ary Plat (PL05-08), and Preliminary Planned Unit Development (PUD05-02) for a Portion of the <br />st Quadrant. <br /> <br />1. The site is zoned Mix.ed-Use (MX) <br /> <br />2. The City has received a proposal by Applicant for a site plan review, preliminary plat, and <br />planned unit development in connection with a housing development of approximately 700 units. <br /> <br />3. Under a Planned Unit Development preliminary approval process, increased density, height and <br />land uses are reviewed and considered. <br /> <br />4. Section 7-240 of the Zoning Code (Chapter 7: Planned Developments) identifies the following <br />criteria for Planning Commission and City Council Action: <br /> <br />a. The consistency of the proposed development with the adopted or proposed <br />comprehensive plan for the City. <br />b. The extent to which the proposed development is designed to form a desirable and <br />unified environment within its own boundaries in terms of relationship of structures, <br />patterns of circulation, visual character, and sufficiency of drainage and utilities. <br />c. The extent to which the proposed uses will be compatible with present and planned uses <br />in the surrounding area. <br /> <br />I <br /> <br />!i i <br />! ! <br />
