<br />, <br /> <br />!.. <br /> <br />." <br /> <br />RESOLUTION NO.9 3 - 0 6 2 <br /> <br />ST ATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING A SPECIAL USE PERMIT TO <br />ALLOW A CHURCH AND SCHOOL TO LOCATE IN THE B-3, GENERAL BUSINESS <br />DISTRICT KNOWN AS APPLICATION SP-I72A. <br /> <br />WHEREAS, an application for a Permit has been made by Church Upon the Rock; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was filed with the City of New Brighton on <br />November 25, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on December 16, 1992, which was continued due to a lack of a City Council quorum for <br />the December 22, 1992, City Council meeting and rescheduled to January 19. 1993, all <br />persons present at the hearing were given an opportunity to be heard. <br />3. The City Council considered SP-l72A at its January 26, 1993, March 9, 1993, April 13, <br />1993, and April 27, 1993, meetings. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to SP-I72A: <br />1. The City's Comprehensive Plan designates the subject site for General Business. <br />2. The City's Zoning Ordinance classifies the site as B-3, General Business. <br />3. The applicant is proposing to purchase and locate a church and school in the Rice Creek <br />Shopping Center facility. <br />4. A church and a school are classified as special uses in the B-3 district. <br />5. According to Section 8-110, the City Council may permit special uses in the B-3 district <br />when it is deemed such special uses are essential or desirable to the public convenience, <br />welfare, and are in harmony with the Comprehensive Plan. <br />6. According to Section 8-130, the Planning Commission shall not recommend approval of a <br />special use unless it satisfies the following standards: <br />a. That the establishment, maintenance or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property <br />in the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />e. That the special use shall in all other respects, conform to the applicable regulations <br />of the district in which it is located. <br />7. The proposed church would have a congregation of up to 650 people and the school would <br />enroll up to 180 students in grades K-8. <br />
