<br />>> <br /> <br />-.... <br /> <br />RESOLUTION NO. 93- 045 <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,.( <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APRROVING PRELIMINARY PlANNED <br />RESIDENTIAL DEVELOPMENT PRO-56 AND PRELIMINARY PlAT Pl.202. <br /> <br />WHEREAS, an application for preliminary PRO-56 and preliminary PL-202 has been made by <br />Harstad Companies; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for PRO-56 and PL-202 was filed with the City of New Brighton on <br />February 26, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing \ <br />on March 16, 1993, and all persons present at the hearing were given an opportunity to <br />be heard. <br />3. The City Council considered PRD~56 and Pl-202 on March 23, 1993. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to PRO-56 and Pl-202: <br />1. The subject property is vacant and zoned R-2, Two Family Residential. <br />2. The subject site is 6.9 acres in size. <br />3. The applicant is proposing 7 two-family homes for the subject site. <br />4. The maximum density allowed in the R-2 district is 6.9 units per acre and when overlayed <br />with the PRO Ordinance allows a density of 8.7 units per acre. <br />5. The buildable area of the site is 3.3 acres (after park land and right-of-way dedication) <br />which, when combined with the proposed 14 residential units (7 two-family homes), <br />creates a density of 4.2 units per acre. <br />6. The City's Park Dedication Ordinance requires the owner of land being subdivided to <br />dedicate to the City a reasonable amount of land for pUblic park purposes not to equal <br />less than 10% of the total land area. <br />7. The development would include a land swap wherein the applicant would develop 38,440 <br />square feet of existing City park land for two-family homes and, in exchange, would <br />dedicate 67,750 square feet of land for park purposes resulting in a total park land <br />dedication of 29,310 square feet or 14%. <br />8. The proposed development would comply with the City's Comprehensive Plan and with <br />existing surrounding land uses. <br />9. The preliminary plat entitled Innsbruck Park Estates 3rd Addition proposes two-family lots <br />which adequately accommodate the proposed structures and is consistent with the <br />subdivision standards of Chapter 26 of the New Brighton City Code. <br />10. The preliminary PRO is consistent with the PRO provisions stated in Section 7-010 of the <br />New Brighton Zoning Ordinance. <br /> <br />BE IT FURTHER RESOLVED, the application PRO-56 and PL-202 is hereby approved subject to the <br />following conditions: <br />1. Grading plan to be approved by City Engineer and Park and Recreation Director. <br />2.
