<br />~ <br /> <br />~ <br /> <br />~ <br /> <br />RESOLUTION NO. 93-93-043 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT APPLICATION SP-175. <br /> <br />WHEREAS, an application for a special use permit has been made by Independent School District <br />No. 621 (Sunnyside School); and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a special use permit, SP-17 5, was filed with the City of New Brighton <br />on February 26, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on March 16, 1993, and all persons present at the hearing were given an opportunity to <br />be heard. <br />3. The City Council considered SP-175 on March 23, 1993. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to SP-175: <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. A school is a special use in an R-l district. <br />3. Sunnyside Elementary School is presently occupying the site. <br />4. Any expansion or enlargement to the structure or operation of a special use requires the <br />approval of a special use permit. <br />5. A 600 square foot addition is proposed for Sunnyside Elementary School for storage <br />purposes. <br />6. The establishment, maintenance or operations of the special use will not be detrimental to <br />or endanger the public health, safety, morals, comfort, or general welfare. <br />7. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhOOd. <br />S. The establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />9. Adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />10. The special use shall in all other respects, conform to the applicable regulations of the <br />district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-175 is hereby approved subject to the following <br />conditions: <br />1 . Conformance and adherence to all standards for special use permits as pertains Section <br />S- 1 10 and S- 130 of the New Brighton Building Code. <br />2. Independent School District No. 621 make necessary improvements to the off-street <br />parking area as per NC-91 by September 1, 1994. <br />3.
