<br />! <br /> <br />RESOLUTION NO. 93-029 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING VN-292. <br /> <br />WHEREAS, an application for a variance has been made by Wayne Eck; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for variance was filed with the City of New Brighton on January 29, <br />1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on February 16, 1993, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered VN-292 at its February 23, 1993, meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the Planning Commission makes the following <br />Findings of Fact in respect to VN-292: <br />1. The property is zoned R-l, Single Family Residential. <br />2. The required sideyard setback in the R-l district is 5 feet. <br />3. The applicant is requesting a 1.5 foot sideyard setback variance to construct a garage <br />and house addition 3.5 feet from the north sideyard property line, which borders on a <br />vacant lot. <br />4. The subject lot has a steep slope to the east and the existing house is centered on the <br />75 foot wide lot thus making it difficult and impractical to place the proposed garage <br />and house addition on the subject lot and still comply with the required sideyard <br />setbacks . <br />5. The proposed garage and house addition would not have a negative impact on <br />surrounding properties and would be in keeping with the character and aesthetics of <br />the neighborhood. <br />6. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship pertaining to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-292 is hereby approved. <br /> <br />Adopted this 23rd day of February, 1993 <br /> <br />~~ <br /> <br />Robert Benke, ayor <br /> <br />A TrEST: - <br /> <br />~rnlc~ <br /> <br />David M.
