<br />RESOLUTION NO.93-028 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION <br /> <br />WHEREAS, an application for a variance has been made by Deborah and Gregory <br />Meyers; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1 . An application for a variance was filed with the City of New Brighton on <br />January 24, 1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on February 16, 1993, and all persons present at the hearing <br />were given an opportunity to be heard. - <br />3. The City Council considered VN-291 at its February 23, 1993, meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the Planning Commission makes the following <br />Findings of Fact in respect to VN-291 : <br /> <br />1. That the property is zoned R-1, Single Family Residential. <br />2. That the required front yard setback in an R-1 district is 30 feet. <br />3. That the applicant is requesting a 16.5 foot front yard setback variance to <br />construct an addition to a single family home on the subject lot 13.5 feet <br />from the 14th Avenue NW right-of-way. <br />4. That the site is located on a peninsula that was originally platted and <br />developed for cottage development with shallow lots and narrow streets. <br />5. The setback from Long Lake is 50 feet as required by the Department of <br />Natural Resources' Shoreland Management Ordinance. <br />6. Due to the 50 foot shoreland setback and the shallow lot, the proposed <br />addition would encroach into the front yard setback area. <br />7. A stand of mature trees located on the east side of the site prevents <br />locating the addition further to the east away from 14th Avenue NW. <br />8.
