<br />" <br /> <br />" <br /> <br />Council member Wi 1 1 i Am co; <br />adoption: <br /> <br />introduced the following resolution and moved its <br /> <br />RESOLUTION NO. 93 - 0 2 5 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS AND ACQUISITION <br />PURSUANT TO MINNESOTA STATUTES, SECTION 117 RESPECTING DEVELOPMENT <br />DISTRICT NO.1. <br /> <br />BE IT RESOLVED by the City Council (the "Council") of the City of New <br />Brighton, Minnesota (the "City"), as follows: <br /> <br />Section 1. Recitals. <br /> <br />1.01. On December 22, 1981, the Council, acting pursuant to and in <br />accordance with Minnesota Statutes, Chapter 472A, as amended, approved and adopted <br />Resolution No. 2542 which created a development district known as Development District <br />No.1, designated the boundaries thereof, and adopted the Development Program for said <br />District. <br /> <br />1.02. The Council on April 26, 1985, acting pursuant to and in accordance <br />with Minnesota Statutes, Chapter 472A, as amended, adopted Resolution No. 85~44 <br />which modified by enlargement Development District No. l,and which approved and <br />adopted a Modified Development Program for said District. <br /> <br />1.03. On February 9, 1993, the Council in accordance with Minnesota <br />Statutes, Chapter 469 adopted Resolution No. 93~018 which modified the Development <br />District and created within such district New Tax Increment Financing Districts. <br /> <br />1.04. On February 9, 1993, the Council, by Resolution 93-022 accepted <br />the feasibility study for lakeview Business Campus streets and utilities. <br /> <br />1.05. In order to carry out the purposes and objectives of Minnesota <br />Statutes, Chapter 469 (formerly 472A), as amended, the Development District No.1, and <br />the Modified Development Program for said District which is and the effect thereof will be <br />to provide an impetus for commercial and industrial development in the City, to increase <br />employment, and otherwise promote certain public purposes and accomplish certain <br />objectives as specified in the Modified Development Program, and to provide for the <br />location and construction of streets and public activities, the Council has determined that it <br />is necessary to acquire the real property described in the Attachment hereto (the <br />"Property") . <br /> <br />1.06. As of the date of this Resolution, the City has been unable to <br />complete the acquisition of the Property by means of negotiated purchase. <br /> <br />Section 2. Authorization to ACQuire Described Procertv bv Eminent <br />Domain Proceedings Pursuant to Minnesota Statutes. 11 7. <br /> <br />2.01. It is necessary to acquire the Property in order to carry out the <br />purposes and objectives of Minnesota Statutes, Chapter 469, as amended, the <br />
