<br />" <br /> <br />'I) <br /> <br />RESOLUTION NO. 93- 0 10 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-290. <br /> <br />WHEREAS, an application for a variance has been made by Accurate Press; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a variance was filed with the City of New Brighton on December 30, <br />1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on January 19, 1993, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered VN-290 at its January 26, 1993 meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to VN-290: <br />I. The subject property is zoned I -I, Light Industrial. <br />2. The required side street yard setback for buildings in the 1-1 district is 40 feet. <br />3. The applicant is proposing to construct an addition onto an existing building 36 feet from the <br />1st Avenue NW right-of-way. <br />4. The proposed addition would require a 4 foot setback variance. <br />5. The portion of the building addition requiring the 4 foot setback variance would be an <br />enclosed dock area located on the rear of the building. <br />6. The Greenway Corridor along Old Highway 8 at the front of the building would be <br />expanded and landscaped and the required setbacks satisfied. <br />7. The subject site is irregular in shape and is bounded by public streets on three sides. <br />8. The subject site is required to provide a 40 foot setback for buildings and parking aloDj the <br />three property lines adjacent to public streets. The amount of setback area required on site <br />limits the amount of buildable area on the site. <br />9. The proposed development complies with all other City Ordinance requirements and <br />eliminates existing Type IV nonconformities. <br />10. The applicant has demonstrated unique and unusual circumstances pertaining to the site and <br />an undue hardship caused by strict enforcement of the 40 foot setback requirement. <br /> <br />BE IT FURTHER RESOLVED, the application VN-290 is hereby approved subject to the following <br />conditions: <br />1.
