<br />RESOLUTION No. <br />06-028 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOL nON MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL of SP 2006-004. <br /> <br />WHE <br /> <br />WHE <br /> <br />Now <br />respec <br />1 <br />2 <br /> <br />Docum t 1 <br /> <br />S, an application for a special use permit has been made by Chris & Jessica Italiano to <br />permit construction of a front entry porch at a setback of 24' when 30' is normally <br />required and 24' is permitted by Special Use Permit, and <br /> <br /> <br />S, the procedural history of the application is as follows: <br /> <br />1. <br /> <br />An application for a Special Use Permit was filed with the City of New Brighton on <br />February 28, 2006, and <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on March 21, 2006 and all present were given a chance to freely speak at the <br />hearing. <br />The Planning Commission unanimously recommended approval to the City Council <br />for the Special Use Permit request on March 21,2006. <br />On March 28, 2006 the City Council reviewed application SP2006-004. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />ERE FORE BE IT 'RESOLVED, the City Council makes the following Findings of Fact in <br />o SP 2006-004: <br />The subject site is zoned R-l, Single Family Residential District. <br />The applicant is requesting a Special Use Permit to allow the front yard setback to be <br />reduced to 24' in accordance with the following conditions noted within Section 4- <br />040 (3) (B): <br />a. The proposed addition uses the same exterior structure materials and <br />colors as the principal structure and accessories. <br />b. The roof is properly proportioned to and integrated with the roof of th~ <br />principal structure (dwelling) on the property. <br />c. The base of the addition is not open and its appearance is consistent with <br />the base ofthe building. <br />d. The structure shall not exceed 35% of the width of the front of the <br />dwelling, excluding the garage, or shall not exceed twelve feet in width, <br />whichever is less. <br />
