<br />6. The Planning Commission finds that the standards in Section 6-550 are met. <br />7. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable regulations of <br />the district in which it is located. <br />8. he Planning Commission held a public hearing, reviewed the project and found the above <br />riteria to be satisfied and recommended approval to the City Council. <br /> <br />Now THE FORE BE IT RESOLVED, that based upon the above findings of fact the application for a <br />Spe al Use Permit (SP2006-005) and Site Plan (LP2006-001) is hereby approved with the <br />foll ing conditions: <br /> <br />1. x (6) more parking spaces are implemented into the plan, either as surface or underground <br />king or a combination thereof. <br />2. pproval and submittal of a permit by the Rice Creek Watershed District. <br />3. e storm sewer pipe that is proposed to be relocated around the southeast comer of the <br />oposed building be at the applicant's expense. <br />4. easement is granted and filed for municipal access to the storm sewer line that is proposed <br />be relocated around the southeast comer ofthe proposed building. <br />5. e applicant submits a revised landscape plan that incorporates the recommendations of the <br />ity Forrester, which are noted within this report. <br />6. y future change in use of the building or site from the approved plan shall require a Special <br />se Permit. <br /> <br /> <br />Adopted this 8th t day of March, 2006. <br /> <br />Ste1k~~,~an <br /> <br /> <br />iLillbOL <br /> <br />Ma ew Fulton, City Manager <br />
