<br />~; <br /> <br />I <br />:f <br /> <br />RESOLUTION NO. 92-084 <br /> <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-287. <br /> <br />WHEREAS, an application for a variance has been made by Wayne Thorson; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1 . An application for a variance was filed with the City of New Brighton on July 31, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on August 18, 1992, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered VN-287 at its August 25, 1992, meeting. <br /> <br />ii <br />:! <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-267: <br />1. The property is zoned R-1, Single Family Residential. <br />2. The required frontyard setback in an R-1 district is 30 feet. <br />3. The required sideyard setback in the R-1 district is 5 feet. <br />4. The applicant is requesting an 8 foot frontyard setback variance and a 2 foot sideyard <br />setback variance to construct a garage 22 feet from the Oakwood Drive right-of-way and <br />3 feet from the south sideyard property line. <br />5. The subject lot slopes to the east and the existing house is centered on the 75 foot wide <br />lot thus making it difficult and impractical to place the proposed garage on the subject lot <br />and still comply with the required setbacks. <br />6. The adjacent property owner to the south at 1760 - 7th Street NW was granted special <br />permission to construct a garage with a 15 foot street sideyard setback from Oakwood <br />Drive. <br />7. The proposed 22 foot frontyard setback for the subject garage would allow for a gradual <br />increase in building setbacks along Oakwood Drive from the 15 foot street sideyard <br />setback adjacent on the south to the 30 foot frontyard setback adjacent on the north. <br />8. The proposed garage would be setback 3 feet from the south side property line, <br />however, the garage would be located 23 feet from the neighbor's house to the south. <br />9. The applicant currently has no garage and the proposed garage would eliminate all <br />existing outside storage on the subject lot. <br />10. The proposed garage addition would not have a negative impact on surrounding <br />properties and would be in keeping with the character and aesthetics of the <br />neighborhood. <br />11.
