<br />.. <br /> <br />RESOLUTION NO. 92- 066 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING LONG-TERM LITIGATION SETTLEMENT <br />AGREEMENT IMPLEMENTING AGREEMENT (VSAGIA). <br /> <br />WHEREAS, the City Council of the City of New Brighton and the U.S. Army have <br />entered into a Litigation Settlement Agreement (LitSAG) that addresses the restoration of <br />the City water supply, and <br /> <br />WHEREAS, the granular activated carbon (GAC) water treatment facility provided <br />for in the LitSAG as a part of an overall contaminated groundwater recovery system is <br />I now completed and in service, and <br /> <br />WHEREAS, the LitSAG provides for the preparation of a separate implementing <br />agreement for operation of the GAC water treatment facility, and <br /> <br />WHEREAS, City Staff and legal and engineering consultants have drafted, <br />. , negotiated, and approved the attached agreement, which provides for long-term operation <br />and maintenance of the GAC water treatment facility, <br /> <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />Brighton, that the attached Long-Term Litigation Settlement Agreement Implementing <br />Agreement (L2SAGIA) for long-term operation of the GAC water treatment facility is <br />hereby approved and the Mayor and Manager are authorized to execute the same on behalf <br />of the City in the form attached, or such modified form as may be approved by the <br />Council. <br /> <br />Adopted this 23rd day of June, 1992. <br /> <br />~ <br />Robert Benke ayor <br /> <br />'i .
