<br />RESOLUTION No. 05-061 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />SOLUTION MAKING FINDINGS OF FACT AND APPROVING OF SP05-13. <br /> <br /> <br />HEREAS, an application for a Special Use Permit by CD Companies; and <br /> <br />HEREAS, the procedural history of the application for a Special Use Permit is as <br />follows: <br />1. An application was filed with the City of New Brighton on July 1, 2005. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on July 19,2005, and all persons present at the hearing were <br />given an opportunity to be heard. <br />3. The City Council considered the request on July 26, 2005 <br /> <br />W, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact <br />in respect to SP05-13: <br /> <br />1. The subject site is zoned B-4, Downtown Business. <br />2. The entire development area is roughly 10 acres in size and the commercial <br />component is roughly 7 acres in size. <br />3. The applicant is proposing a one-day auto sales event on Lots 1 and 2, Block 1 <br />of Main Street Village addition to New Brighton (500, 550 Main Street). <br />4. Automobile sales uses are required to obtain a Special Use Permit. <br />5. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br /> <br />a) That the establishment, maintenance, or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, comfort <br />of general public. <br />b) That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />c) That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br />d) That adequate utilities, access roads, drainage and/or necessary facilities <br />have been or are being provided. <br />e) That the special use shall, in all other respects, conform to the applicable <br />regulations of the district in which it is located. <br /> <br />6. The Planning Commission held a public hearing, reviewed the project and <br />found the above criteria to be satisfied and recommended approval to the City <br />Council. <br />7.
