, , HEREAS, the City Council makes the following Findings of Fact in respect to PL05-06: 1. The site is zoned R1-A, single family residential. 2. The applicant is proposing to create three lots of record. 3. The proposed lot areas are as follows: Tract A: 8,360 sq. ft. Tract B: 11,520 sq. ft. 4. The lot area requirements are met. 5. Section 4-140 (2) A states that lots in the R-lA District shall be 40 feet wide at the front lot line, building setback line, and rear lot line abutting an alley. 6. The proposed lot widths are as follows: Tract A: 66 ft. at the 5th Avenue right-of-way; and, 66 ft. at the alley Tract B: 94 ft. at the 5th Avenue right-of-way; and, 74ft. at the alley 7. The Proposed Tracts meet the minimum lot width requirement for a lot abutting an alley. 8. The proposed new lots shall be legally described as depicted in Attachment A to this Resolution. 9. Accessory structures without primary structures in the R-1A Zone are not allowed. 10.Proposed Tract B will be non-conforming when the lot split is officiaL 11. The applicant has agreed to bring the proposed non-conforming lot into compliance by December 31, 2005. 12. The applicant has further agreed to submit a letter of credit covering the costs of demolition ofthe existing detached garage on Tract B. W THEREFORE BE IT RESOLVED, that based upon the above fmdings of fact the application for a Minor Subdivision (PL05-06) is hereby approved with the following conditions: dopted this 23th day of August, 2005. 1. Tract B is brought into conformance by December 31,2005. 2.
