<br />J.. <br /> <br />RESOLUTION No. _05-093 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF A MINOR SUBDIVISION. <br /> <br />WHEREAS, an application has been made by Mr. Gary Wright to be considered for a <br />Minor Subdivision by the City Council for property located at 327 11 th Avenue NW. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Minor Subdivision was filed with the City of New <br />Brighton on October 4, 2005. <br /> <br />2. Notification was sent out to surrounding properties and published in the <br />New Brighton Bulletin. <br /> <br />3. The City Council considered the application at a public hearing on October <br />25,2005. <br /> <br />4. The City Council considered the request on October 25, 2005 and approved <br />the subdivision/preliminary plat. <br /> <br />HEREAS, the City Council makes the following Findings of Fact in respect to PL05-06: <br />1. The site is zoned R1-A, single family residential. <br />2. The applicant is proposing to create three lots of record. <br />3. The proposed lot areas are as follows: <br />Parcel A: 11,342 sq. ft. <br />Parcel B: 17,955 sq. ft. <br />4. The lot area requirements are met. <br />5. The City Council approved the lot split with the following legal <br />descriptions (as depicted in Attachment A to this Resolution): <br />A. Proposed Tract A: the north 120 feet of Tract C, subject to 3A <br />Street and 11 th Avenue, Registered Land Survey Number 40, <br />Ramsey County, Minnesota. <br />B. Tract C, except the north 120 feet thereof, subject to 11th Avenue, <br />Registered Land Survey Number 40, Ramsey County, Minnesota. <br /> <br />7. Accessory structures without primary structures in the R-1 Zone are not <br />allowed. <br />8. Proposed Tract A will be non-conforming when the lot split is official. <br />9.
