<br />~ <br /> <br />RESOLUTION NO.05-094 <br />CITY OF NEW BRIGHTON <br /> <br />OLUTION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL OF VN 05-03. <br /> <br /> <br />S, an application for a variance has been made by Mr. David Long, Murphy Brothers <br />Co., on behalf of Steve and Judy Kuczenski (property owners) to construct an <br />attached 3rd stall garage located at 2830 Forestdale Road and <br /> <br />S, the procedural history of the application is as follows: <br /> <br />1. <br /> <br />1. An application for a Type-4 Non-Conforming Use Permit and variance were filed <br />with the City of New Brighton on August 12, 2005; and <br /> <br />2. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on September 20, 2005 and all present were given a chance to freely <br />speak at the hearing; and <br /> <br />3. <br /> <br />3 The Planning Commission on September 20, 2005 recommended the City Council <br />approve of a Type-4 Non-Conforming Use Permit to construct a laundry and family <br />room addition, but recommended the City Council deny a variance request to <br />reduce the front yard setback for construction of a 3rd stall garage; and <br /> <br />4. <br /> <br />4 The City Council on September 27, 2005 adopted a resolution approving a Type-4 <br />Non-Conforming Use Permit to construct a laundry and family room addition, but <br />tabled action on a variance request to reduce the front yard setback for <br />construction of a 3rd stall garage and redirected the applicant to go back to the <br />Planning Commission for additional review and comment. <br /> <br />The Planning Commission re-considered the applicant's variance request on <br />October 18, 2005 and determined that one or more of the conditions identified in <br />Section 8-230 had been satisfied and further adopted a resolution recommending <br />that the City Council approve VN05-03. <br /> <br />Now EREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />resp t to VN 05-03: <br /> <br />The subject site is zoned R-1, Single Family Residential. <br /> <br />The applicant is requesting a variance to reduce the required front yard setback <br />from 30 feet to 21 feet in order to construct an attached 3rd stall garage. <br /> <br />Sec. 8-230 of the City's Zoning Code prescribes the variance standards as <br />follows: <br /> <br />(1) Undue hardship. <br />I:\CO CIL\REPORTS\2005\Comm.
