<br />" <br /> <br />RESOLUTION No. 05-095 <br />CITY OF NEW BRIGHTON <br /> <br />RESOL ION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL of SP 05-15. <br /> <br />WHER s, an application for a special use permit has been made by Mr. Ray Hable to <br />construct a detached garage in 840 square feet in size located at 2529 County <br />Rd. H; and <br /> <br /> <br />1. <br /> <br />WHER s, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton <br />on September 13, 2005 <br /> <br />2 On October 18, 2005 the Planning Commission held a public hearing to review <br />the request and adopted a resolution recommending the City Council approve <br />SP05-15 with conditions. <br /> <br />Now IlIEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respe to SP 05-15: <br /> <br />1. The subject site is zoned R-1, Single Family Residential. <br /> <br /> <br />The applicant is requesting a Special Use Permit to construct an 840 square <br />foot detached garage. <br /> <br />Garages larger than 624 ft.2 in size are required to obtain a Special Use Permit. <br /> <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br />a. That the establishment, maintenance, or operations of the special <br />use will not be detrimental to or endanger the public health, safety, <br />morals, comfort of general public. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br /> <br />c. That the establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding <br />property for uses permitted in the district. <br /> <br />d. That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br /> <br />I:\CO CIL\REPORTS\2005\Comm.
