<br />1. he subject site is zoned B-4, Downtown Business. <br /> <br />2. "post office" retail use for Building D in the proposed amendment of the <br /> <br />eneral Development Plan for GP05-01 is compatible with and compliment <br />urrounding land uses. <br /> <br />3. Developer shall add the amended PUD to the declaration of covenants and <br />restrictions to assure development in accordance with the General <br />Development Plan and conditions imposed by the City. <br />4. Except where amended, the developer shall adhere to the conditions of <br />approval in the General Development Plan and Resolution 01-059. <br />5. Under the previous General Development Plan, the approved land use for <br />Building D is a restaurant. <br />6. The proposed change for Building D is to allow a retail post office land use. <br />7. Any proposed changes to the General Development Plan in the B-4 district <br />requires an amendment to be considered under the PUD procedures in the New <br />Brighton Zoning Code. <br /> <br /> <br />BE IT RTHER RESOLVED, the City Council approves GP05-01 with the following <br />condi ns: <br /> <br />1, Final Site Plans are submitted for Building D (post office) for review and <br />approval by the City Council. Any future site plan shall continue to maintain the <br />plaza/courtyard function for community events and/or similar activities. <br />2. A Declaration of Covenants and Restrictions is reviewed and approved by <br />the Community Development Director and the City Attorney for Building D <br />and Building E ( Lot 4, Block 1, Parcels A and B, Main Street Village Addition <br />to New Brighton) and filed with Ramsey County. In addition, the Developer <br />shall add the amended PUD to the declaration of covenants and restrictions <br />to assure development in accordance with the General Development Plan <br />and conditions imposed by the City. <br />3.
