<br />- <br /> <br />;: <br /> <br />, <br /> <br />I" <br /> <br />~ <br /> <br />:i <br /> <br />RESOLUTION NO. 92. 043 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING SPECIAL USE PERMIT SP.169. <br /> <br />, <br />. , <br /> <br />WHEREAS, an application for a special use permit has been made by Christ the King Church; <br />and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit, SP-169, was filed with the City of New <br />Brighton on February 28, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on April 21, and all persons present at the hearing were given an opportunity to <br />be heard. <br />3. The City Council considered SP.1 69 on April 28, 1992. <br /> <br />'1 <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact <br />in respect to SP.169: <br /> <br />1. The subject site is zoned R.1, Single Family Residential <br />2. The operation of a church in an R.1 district is a special use. <br />3. Christ the King church proposes to construct a 21,406 square foot addition onto the <br />existing church building for classrooms, a gymnasium, meeting room, chapel, kitchen, <br />and offices. <br />4. The proposed addition and related site improvements would comply with the R-1 <br />district and parking standards. <br />5. The existing single family home on site would be removed to accommodate the <br />proposed parking lot. <br />6. The proposed grading and drainage plan would not increase the volume of storm water <br />discharged to the east toward Oakwood Drive and would decrease the rate of flow of <br />stormwater from the church site to both the east and south. <br />7. Improvements to the catch basins on 7th Street NW and restoration of the bituminous <br />berm on 7th Street NW and Oakwood Drive would serve to reduce the amount of <br />stormwater flowing into the Oakwood drive storm sewer pipe from 7th Street NW, <br />thus, helping to keep the backwater valve open (located between the backyards of <br />homes east of Oakwood drive and the Oakwood Drive storm sewer pipe) and allowing <br />flowage from the northeast retention pond and affected backyards to enter the catch <br />basin and drain directly into the Oakwood Drive storm sewer pipe. <br />8. The proposed landscape plan would establish a landscape screen around the periphery <br />of the subject site. <br />9. The establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort, or general welfare. <br />1 Q. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />11. The establishment of the special use will no impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />12. Adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />1 3. The special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br /> <br />Page 1 of 2 <br />
