<br />il <br />,il.... .....'" <br /> <br /><:. <br /> <br />'.. <br /> <br />RESOLUTION NO. 92.018 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING SPECIAL USE PERMIT <br />APPLICATION SP-I66. <br /> <br />WHEREAS, an application for a Special Use Permit has been made by City of Minneapolis Water <br />Works; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Special Use Permit was filed with the City of New Brighton on January 3, <br />1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />January 21, and February 18, 1992, and all persons present at the hearing were given an <br />opportunity to be h.eIlrd. , <br />3. The City Council considered S1>-I66 at its Febiuary 25, 1992, meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact <br />in respect to SP-166: <br /> <br />1. <br />2. <br />3. <br />4. <br />\i <br />5. <br />6. <br />7. <br /> <br />The subject site is zoned R-I, Single FamiJy Residential. <br />The applicant is proposing to deposit 25,otx> to 28,000 cubic yards of fill material on the <br />Hilltop Reservoir site in -New Brighton. <br />The proposed fill operation is not related to an approved development project for the subject <br />site. <br />Due to the amount of fill materi; to be deposited on the Hilltop Reservoir site, the City is <br />requiring a Special Use Pefmiybe required in addition to the administrative permit process <br />required by Chapter 14 of the City Code. <br />The proposed fill operation would require as many as 100 truck loads of fill to be hauled from <br />the East River Road site to the Hilltop site per day. <br />The proposed 100 truck loads per day breaks down to 200 truck trips per day when both <br />loaded and unloaded truck trips are considered. <br />The proposed number of truck trips per day would seem to violate the Special Use Permit <br />Standard by creating a negative impact on the immediate residential neighborhood and on <br />residential properties along the truck routes as well as the safety and comfort of the general <br />public. <br /> <br />BE IT FURTHER RESOLVED, the application SP-l66 is hereby denied. <br /> <br />Adopted this 25th day of February, 1992. <br /> <br />'I <br /> <br /> <br />,; <br />.1 <br />I; _ATIEST: <br /> <br />~ <br /> <br />Finance Director/City Clerk <br /> <br />J~,m,c~ <br /> <br />David M.
