<br />RESOLUTION No. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION AUTHORIZING RECONVEYANCE OF TAX- <br />FORFEITED LANDS TO THE STATE OF MINNESOTA <br />SUBJECT TO CERTAIN CONDITIONS <br /> <br />WHEREAS, the State of Minnesota has conveyed to the City of New Brighton certain tax- <br />forfeited land, described as follows: <br /> <br />Lots 1,2 and 7, Block 10, Oakwood Manor Terrace Plat 3, Ramsey <br />County, Minnesota <br /> <br />(the "Property"); and, <br /> <br />WHEREAS, Ramsey County requires the following described parcel for the widening of <br />Silver Lake Road: <br /> <br />The East 5 feet of Lots I and 7, Block 10, Oakwood Manor Terrace Plat 3, Ramsey <br />County, Minnesota <br /> <br />("Right of Way Parcel"); and <br /> <br />WHEREAS, the City has a continuing need for the following described parcel for ponding <br />and storage of City storm water <br /> <br />Lots I and 7, except the East 5 feet and all of Lot 2, Block 10, Oakwood Manor <br />Terrace Plat 3 <br /> <br />(the "Remainder Parcel"), and it is in the public interest for the City to retain said Remainder Parcel; <br />and <br /> <br />WHEREAS, under Minnesota Statutes, Section 282.01, subdivision Id, the City may not <br />convey the Property directly to Ramsey County but must instead reconvey the Property to the State <br />of Minnesota so that the Right of Way Parcel can be conveyed to Ramsey County, Public Works for <br />road right of way; and <br /> <br />WHEREAS, W1der Minnesota Statutes, Section 282.01, Subdivisions la through Ie, <br />requires the City submit an application for conveyance of tax-forfeited lands for an authorized <br />public use; and <br /> <br />WHEREAS, the City COW1cil has determined that this reconveyance and application are in <br />the public interest. <br /> <br />289839vl CBR NE136-178 <br />
