I <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />, I <br />II <br /> <br /> <br />WHEREAS, as an application for special use permit has been made by Belair Builders, Inc, <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for special use permit, SP-164, was filed with the City of New Brighton on <br />June 28, 1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on July 16, 1991, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered an application for SP-164 at its July 23, 1991, meeting. <br /> <br />I <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council of the City of New Brighton makes the <br />following Findings of Fact in respect to $P-164. <br /> <br />,j <br />I, <br /> <br />1. The subject site is zoned 1-1, light Industrial. <br />2, The exterior storage of black dirt, bituminous, concrete, and gravel is a special use in the 1-1 <br />district. <br />3. The establishment, maintenance or operations of the special use will not be detrimental to or <br />endanger the public health, safety, morals, comfort or general welfare, <br />4. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br />5, The establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />6. Adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />7. The special use shall in all other respects. conform to the applicable regulations of the <br />district in which it is located, <br /> <br />'j <br /> <br />, <br />I; <br />II <br />!: <br />:) <br />!! <br />II <br />I' <br /> <br />BE IT FURTHER RESOLVED, the application for SP-164 is hereby approved subject to the <br />following conditions: <br /> <br />1, <br />2. <br /> <br />Approval of and continuing compliance with the terms and conditions of LP-259. <br />A plan proposing landscaping and screening for the 40 foot frontyard setback area and 15 <br />foot sideyard setback area be submitted for City Council approval within six months after <br />the landfill area has been remediated or closed by the MPCA or the 30 foot road easement is <br />improved as a public way or street. <br />The exterior storage material and goods must be setback 40 feet from the front property <br />line, 15 feet from the side property line, 20 feet from the rear property line. and shall not <br />exceed 40 feet in height. <br /> <br />3. <br /> <br />;-r" <br />i. <br />f/-- <br />Ii <br /> <br />t'~ <br />.;, <br />.';1- <br />i! <br /> <br />Adoptoo .tilis S"th day of October, , 991 . <br /> <br />11 ~ <br /> <br />---' <br /> <br />~ <br />Robert Benke, ayor . <br /> <br />{'.
