<br />'.. <br /> <br />Ii <br />" <br /> <br />~ <br /> <br />I: <br />,I <br />\j <br />:1 <br />~ ~ <br /> <br />RESOLUTION NO. 91- 089 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />i: <br />'I <br />! <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-283. <br /> <br />WHEREAS, an application for a variance has been made by Opus Corporation; and <br /> <br />" <br />, <br /> <br />i <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on June 28, 1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on July 16, 1991, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered the application at its September 19, 1991 meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact <br />in respect to VN-283: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />2. The required frontyard setback for off-street parking in an 1-2 district is 40 feet. <br />3. The requested ten foot. setback variance would allow a portion of the proposed off-street <br />parking area to be located 30 feet from the 2nd St. NW right-of-way. <br />4. The odd configuration of the subject lot and the steep slope to the south are unique <br />circumstances which place design constraints on the subject lot, <br />5. The proposed landscape plan would provide for plantings that would serve to screen the <br />off-street parking area from 2nd Street NW and soften the impact of the reduced setback <br />area. <br />6. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship. <br /> <br /> <br />BE IT FURTHER RESOlveD, the application VN-283 is hereby approved subject to the <br />following conditions: <br /> <br />1.
