<br />~ <br /> <br />6. <br /> <br />The thermal processor incineration process has been formally approved by <br />the Minnesota Pollution Control Agency (MPCA). <br /> <br />~ <br />f <br />I <br /> <br />j <br />I <br /> <br />7. <br /> <br />The MPCA is presently reviewing a request by Bell Lumber and Pole to <br />extend the Air Emission Facility permit. <br />The on.site incineration process would comply with the New Brighton Zoning <br />Code, Section 8-130 (a), (b), (c), (d), and (e), special use permit standards, <br />and Section 6-390 (f), (g), (h) and (i) regarding performance standards in the <br />1-2 districts. <br />The thermal processor incineration process has been endorsed by the New <br />Brighton Environmental Quality Commission. <br />A 50 x 80 foot metal structure has been constructed to accommodate the <br />rotary kiln thermal processor on a temporary basis. <br />The on-site incineration process is scheduled to be completed by December <br />1, 1991, and the rotary kiln thermal processor and metal structure is <br />scheduled to be removed from the site by January 1, 1992. <br />The uses and structures on the site are Type IV nonconformities which could <br />not be expanded on a permanent basis without first securing a proper permit <br />therefor. Furthermore, because of its temporary nature, the proposal has not <br />undergone site plan review to consider such matters as parking and <br />landscaping. Therefore, this permit would not be granted but for the facts <br />that the use is to be on a temporary basis only and that there is a compelling <br />need to provide for the correction of contaminated soils problems. <br /> <br />8. <br /> <br />9. <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />BE IT FURTHER RESOLVED, the application for SP-135 is hereby approved until <br />January 1, 1992, conditioned on: <br /> <br />1 . The Air Emission Facility Permit be extended by the MPCA. <br />2. The on-site rotary kiln thermal processor may only be operated during the <br />time period specified by the Air Emission Facility Permit approved by the <br />MPCA. <br />3.
