<br />t;j.' -- <br /> <br />RESOLUTION NO. 91- 52 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-282 (WEXFORD HEIGHTS <br />PLAT) . <br /> <br />j! <br /> <br />WHEREAS, an application for a variance has been made by Arcon Development, Inc.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on March 29, <br />1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on April 16, 1991, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered VN-282 at its meeting on May 14, 1991. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-282: <br /> <br />1. The property is zoned R-l, Single Family Residential. <br />2. The required front yard setback in an R-l district is 30 feet. <br />3. The applicant is requesting a 5 foot variance from the required frontyard setback to <br />allow for the construction of new homes 25 feet from the front lot line of lots 4, 5, <br />6,7,13,14,15, and 16, Block 1, Wexford Heights. <br />4. The subject lots back up to a steep slope which borders the plat on the west. <br />5. The requested 5 foot setback variance would allow for additional rearyard space on <br />the subject lots. <br />6. The applicant has narrowed right-of-ways, shortened lots between the subject lots <br />and Silver Lake Road, and lengthened the subject lots in an effort to create adequate <br />rearyard area. <br />7. Since the applicant has included design methods in the proposed plat to increase the <br />depth of the subject 8 lots in response to the steep slope, the strict enforcement of <br />the 30 foot front yard setback would appear to cause the applicant and future <br />homeowners an undue hardship. <br />8. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship related to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-282 is hereby approved subject to the <br />" following conditions: <br /> <br />1.
