<br />.; <br /> <br />RESOLUTION NO. 91- 026 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPUCA TION FOR A <br />NONCONFORMING USE PERMIT NC-89. <br /> <br />WHEREAS, an application for a nonconforming use permit, NC-89, has been made by <br />Atonement Lutheran Church to permit the construction of a 3,500 square foot church addition on <br />a site with Type IV nonconformities. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a nonconforming use permit, NC-89, was filed with the City of New <br />Brighton on March 1, 1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on March 19, 1991, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered the application for NC-89 on March 26, 1991. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to NC-89: <br /> <br />1. The following Type IV non conformities exist on the property: <br />A. Lack of poured-in-place continuous concrete curbing around all parking and drive <br />areas. <br />B. Lack of striped parking stalls. <br />2. The subject site is zoned R-3A, Multiple Family Residential. <br />3. Section 11-020 (61 of the Zoning Code requires poured-in-place concrete curbing around <br />all parking areas serving institutional or church developments. <br />4. Section 11-020 (61 of the Zoning Code requires all parking stalls to be marked with <br />white or yellow painted lines not less than four inches wide. <br />5. The applicant proposes poured-in-place concrete curbing around all parking and drive <br />areas. <br />6. The applicant proposes to stripe all parking stalls. <br />7. The applicant has done everything practical to eliminate and reduce the existing Type IV <br />nonconformities. <br /> <br />BE IT FURTHER RESOLVED, the application NC-89 is hereby approved subject to the <br />following conditions: <br /> <br />1 .
