<br />" <br /> <br />RESOLUTION NO. 91- C \ 3> <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A ROAD <br />EASEMENT. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1 . Mike Mezzenga submitted a petition, as fifty percent of the property owners <br />involved, to vacate the road easement. <br />2. That the City Council, pursuant to published notices, held a public hearing on the <br />vacation, all persons present at the hearing were given an opportunity to be heard. <br />3. The written comments of City Staff were considered. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New Brighton <br />makes the following Findings of Fact in respect to the proposed vacation: <br /> <br />1 . The road easement to be vacated is unimproved and does not serve a public <br />purpose. <br />2. There are not utilities within the road easement. <br />3. The subject road easement would be replaced by the utility easement and public <br />right-of-way proposed on the Creekwood Estates plat. <br /> <br />BE IT FURTHER RESOLVED that the Council hereby vacates the road easement legally <br />described as follows: <br /> <br />A 60 foot road easement over the South % of the Southwest % of the Northwest % of Section <br />20. Township 30 North, Range 23 West, Ramsey County, Minnesota, and over that part of the <br />Northwest % of the Southwest % of said Section 20 lying Northeasterly of Long Lake Road, the <br />centerline of which easement is described as follows: Beginning at a point on the North line of <br />said South % distant 30 feet East of the West line of 14th Avenue Northwest; thence South on <br />the South extension of the centerline of 60 foot 14th Avenue to a distance of 59.5 feet; thence <br />Southwesterly by a deflection angle of 10040' to the right, to the Northerly line of Long Lake <br />Road and there terminating. <br /> <br />Adopted this 22nd day of January, 1991. <br /> <br />~ <br />/ ~ / <br />~" ~- <br /> <br />Robert Benk, ayor <br /> <br />~ ,....-.-. <br /> <br />_~ m\~ <br /> <br />David M.
