<br />'" <br /> <br />!: <br />; <br /> <br />RESOLUTION NO. 90- 073 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-281. <br /> <br />, WHEREAS, an application for a variance has been made by Eugene and Roger <br />i Joyce; and <br />! <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />An application for a variance was filed with the City of New Brighton on <br />August 3, 1990. <br />The Planning Commission, pursuant to published and mailed notices, held <br />a public hearing on August 21, 1990, and all persons present at the <br />hearing were given an opportunity to be heard. <br />The City Council considered the application for VN-281 on <br />August 28, 1990. <br /> <br />i i NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />;: Findings of Fact in respect to VN-281. <br /> <br />The property is zoned R-l, Single Family Residential. <br />The required lot width in an R-1 district is 75 feet. <br />The required lot area in an R-l district is 10,000 square feet. <br />The proposed minor subdivision would create two 65 foot wide parcels each <br />having 8,247 and 8,248 square feet of lot area respectively. <br />The applicant is requesting a 10 foot lot width variance for each proposed <br />parcel, aI, 753 square foot lot area variance for Parcell, and a 1,752 <br />square foot lot area variance for Parcel 2. <br />Proposed Parcel 2 is developed with a single family home which would be <br />setback 24 feet from the proposed property line separating proposed <br />Parcels 1 and 2. <br />The surrounding neighborhood contains several 40, 60, and 70 foot wide <br />lots with substandard lot area. <br />Strict enforcement of the R-1 district lot standards would cause the owner <br />an undue hardship because of circumstances unique to the neighborhood <br />and individual property under consideration. <br />The requested variances would not alter the essential character of the <br />neighborhood. <br /> <br />BE IT FURTHER RESOLVED, the application VN-28l is hereby approved <br />i! subject to the following conditions: <br /> <br /> 1. <br /> 2. <br />'. <br />'I <br /> 3. <br />i <br /> <br />I <br />i 1. <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br /> 6. <br /> 7. <br />Ii 8. <br />:'[ 9. <br /> <br />:i <br /> <br />1.
