<br />.;' <br /> <br />ii <br /> <br />RESOLUTION NO. 90- ~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />, RESOLUTION APPROVING LITIGATION SETTLEMENT AGREEMENT <br />, IMPLEMENTING AGREEMENT (LITSAGIA). <br /> <br />WHEREAS, the City Council of the City of New Brighton and the U. S. Army <br />. have entered into a Litigation Settlement Agreement (LitSAG) that addresses the <br />restoration of the City water supply, and <br /> <br />WHEREAS, an element of the LitSAG provides for the construction and <br />, operation of the granular activated carbon (GAC) water treatment facility as a <br />part of an overall contaminated groundwater recovery system, and <br /> <br />WHEREAS, the granular activated carbon water treatment facility is now <br />completed and in service, and <br /> <br />WHEREAS, the LitSAG provides for the preparation of a separate <br />implementing agreement (LitSAGIA) for operation of the granular activated carbon <br />, water treatment facility, and <br /> <br />WHEREAS, City Staff and legal and engineering consultants have drafted, <br />negotiated, and approved the attached agreement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />,i Brighton that the attached Litigation Settlement Agreement Implementing <br />Agreement (LitSAGIA) for operation of the granular activated carbon water <br />'i treatment facility is hereby approved and the Mayor and Manager are authorized <br />to execute the same on behalf of the City in the form attached, or such modified <br />form as may be approved by Counsel. <br /> <br />i Adopted this 14th day of August, 1990. <br /> <br />/~ <br />~ /' ' <br /> <br />Robert Benke ayor <br /> <br />': ATTEST: <br /> <br />. <br /> <br /> <br />~m.~ <br /> <br />David M.
