".!Jr <br /> <br />RESOLUTION NO. 90-61 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION <br />, FOR A NONCONFORMING USE PERMIT NC-87. <br /> <br />WHEREASt an application for a nonconforming use permit, NC-87, has been <br />made by Bell Lumber and Pole to permit the construction of a 1 t 248 square foot <br />'. employee break facility and a 32 t 500 sq. ft. enclosed wood treatment facility on a <br />site with Type IV nonconformities. <br /> <br />WHEREAS t the procedural history of the application is as follows: <br /> <br />An application for a nonconforming use permitt NC-87 t was filed with the <br />City of New Brighton on June It 1990. <br />The Planning Commission, pursuant to published and mailed notices t held <br />a public hearing on June 19, 1990, and all persons present at the hearing <br />were given an opportunity to be heard. <br />The City Council considered the application for a nonconforming use <br />permit on June 26, 1990. <br /> <br />Ii <br />i 1. <br />!I <br /> 2. <br /> 3. <br />!: <br />" <br /> <br />NOW THEREFORE BE IT RESOLVEDt the City Council makes the following <br />Findings of Fact in respect to NC-87: <br /> <br />1. The following Type IV nonconformities exist on the property: <br />A. Lack of bituminous or concrete drive, loading t maneuvering, or <br />parking areas. <br />B . Lack of concrete curbing. <br />C. Lack of adequate setbacks for exterior storage. <br />D. Lack of screening of exterior storage on site south of 1st Avenue NW. <br />E. Emission of odors from wood treating process. <br />The subject site is zoned 1-2, Heavy Industrial. <br />Section 11-020 (a) requires bituminous or concrete drive, loading, <br />maneuvering, or parking areas. <br />Section 11-020 (b) of the Zoning Code requires poured-in-place concrete <br />curbing around all parking, drive, and maneuvering areas. <br />Section 6-930 (j) requires exterior storage areas which exceed six feet in <br />height to meet the district setbacks and requires all exterior storage to <br />be screened. <br />Section 6-930 (h) requires a business to prevent the production of odors <br />beyond the subject site property line. <br />The applicant proposes the attached dust control plan and agreement <br />which is a condition of approval. <br />The applicant proposes poured-in-place concrete curbing along the east <br />side of the office drive for storm drainage purposes. <br />The applicant does not propose to meet the exterior storage standards for <br />setbacks on the subject site or to screen the exterior storage on the site <br />south of 1st Street NW. <br /> <br />;: <br /> <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br />, <br />!, <br /> 6. <br /> 7. <br /> 8. <br /> 9. <br />I <br />I, <br />,i <br />
